PetPad Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the PetPad mobile application and related services (collectively, the “Platform”), operated by Pet Pad For Advertisement and Marketing W.L.L. (“PetPad,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, together with our Privacy Policy and Community Guidelines, which are incorporated by reference. If you do not agree, you must not access or use the Platform.

1. Nature of the Platform

PetPad is a digital platform for pet owners that combines social networking features with service-related functionality available in certain regions. PetPad currently operates within the Gulf Cooperation Council (GCC), beginning in the State of Kuwait, and will expand to additional markets over time.

The Platform enables users to create pet profiles, share pet-related content, interact with other users, and take part in community features. In regions where the service is available, the Platform additionally enables users to discover, book, and pay for pet-related services offered by independent third-party service providers (“Vendors”).

PetPad does not provide pet-related services and does not control how any service is performed once a booking is confirmed. PetPad:

  • Does not employ Vendors;
  • Does not supervise or direct service delivery;
  • Does not guarantee service outcomes or results.

Any service agreement is formed solely between the user and the Vendor.

2. Eligibility and Legal Capacity

2.1 Age Requirements

  • The Platform is not available to individuals under 13 years of age.
  • Users aged 13 to 17 may use the Platform only with the verifiable consent and supervision of a parent or legal guardian.

2.2 Parental Responsibility

By permitting a minor aged 13 to 17 to use the Platform, the parent or legal guardian:

  • Confirms that they have the legal authority to provide consent;
  • Accepts full responsibility for the minor’s activity on the Platform;
  • Agrees to indemnify and hold PetPad harmless from any claims arising from the minor’s use of the Platform.

3. Accounts and Security

You must provide accurate, complete, and current information when creating an account, and keep it up to date. You are responsible for safeguarding your login credentials and for all activity conducted through your account.

PetPad may restrict, suspend, or terminate an account where misuse, a security risk, or non-compliance with these Terms is identified, and may limit or prohibit the operation of multiple accounts at its discretion.

4. Account Types and Verification

The Platform may offer different account types, including regular user accounts and business accounts associated with pet-related businesses (“Business Accounts”). Where Business Accounts are made available, they may be subject to additional requirements, including document submission and verification, and may be offered in free or paid subscription tiers with varying features.

PetPad may, at its discretion, offer verification badges or similar indicators for certain accounts. Verification or a badge indicates only that certain information has been reviewed; it does not constitute an endorsement, certification, or guarantee of the account holder, their conduct, or their services. PetPad reserves the right to modify, suspend, or revoke verification status, badges, account tiers, or related benefits at any time.

5. Public and Private Content

Where the Platform allows you to designate accounts or content as public or private, you acknowledge that public content may be viewed, shared, or interacted with by other users or the public, and that private content is intended to be visible only to approved users. No system can guarantee absolute confidentiality. You are responsible for managing your privacy settings and for the content you choose to share.

6. Vendor Status and Obligations

All Vendors on the Platform are independent legal entities. Each Vendor:

  • Must hold all licenses, permits, registrations, and approvals required under the laws applicable in the jurisdiction(s) in which it operates or provides services;
  • Is solely responsible for the quality, safety, and lawfulness of its services;
  • Represents and warrants that it complies with all applicable health, safety, and animal-welfare regulations, possesses the necessary expertise for the services it offers, and assumes full liability for its services and conduct.

PetPad does not independently verify, monitor, or guarantee Vendor performance.

7. Bookings and Service Delivery

Bookings are facilitated through the Platform based on Vendor availability and the information provided. PetPad does not guarantee service outcomes, suitability, or results, and does not participate in the execution of any service. Any issue arising from service delivery is the responsibility of the Vendor, subject to the refund and support mechanisms described in these Terms.

8. Payments, Fund Holding, and Payouts

8.1 Payment Processing and Collection

Payments on the Platform are processed by MyFatoorah, a third-party payment service provider, which facilitates KNET and other supported payment methods. PetPad collects payments as a commercial collection agent on behalf of Vendors.

Funds may be held temporarily for operational and settlement purposes. Such holding does not create a trust, escrow, fiduciary, or banking relationship, and PetPad is not a financial institution.

8.2 Vendor Payouts

Vendor payouts are governed by separate vendor agreements, which define payout timing, deductions, and settlement terms.

9. Cancellations, Refunds, and Paid Transactions

This section applies to all paid transactions made through the Platform, including bookings, subscriptions, and other paid features.

9.1 Booking Services

  • Bookings cancelled less than 24 hours before the scheduled service time are not eligible for a refund.
  • Bookings cancelled 24 hours or more before the scheduled service time are eligible for a refund, subject to the terms displayed at the time of booking.
  • Late arrival or failure to attend a scheduled booking (a “no-show”) may result in cancellation of the service without a refund.
  • Approved refunds are processed to the original payment method and may take 5 to 10 business days to appear, depending on the payment provider.

9.2 Other Paid Features

Payments for subscriptions, digital features, advertising services, or other non-service offerings are non-refundable, unless otherwise required by applicable law or expressly stated at the time of purchase. PetPad retains final authority over refund determinations, subject to applicable law.

9.3 Service Complaints and Resolution

If you are dissatisfied with a service you booked through the Platform, or you believe it was not delivered as described, you may contact us through the “Contact Us” section within 48 hours of the scheduled service time, and we will assist you with your order. Any refund is handled in accordance with this Section 9, and PetPad may, at its discretion, provide a refund, credit, or other resolution. Responsibility for the service itself, and for any liability arising from it, remains with the Vendor.

10. Pet Health and Safety Responsibilities

Certain services available through the Platform may require pets to meet specific health or vaccination requirements, as determined by the applicable Vendor. You are solely responsible for:

  • Ensuring your pet is healthy and fit for the booked service;
  • Providing accurate and complete information about your pet;
  • Complying with any vaccination or health requirements communicated at or before booking.

Failure to meet applicable health or vaccination requirements may result in refusal of service by the Vendor, cancellation of the booking, or loss of refund eligibility. To the maximum extent permitted by law, PetPad disclaims responsibility for any injury, illness, disease, death, or medical or behavioral outcome arising from the provision of services.

PetPad does not provide veterinary, medical, or behavioral advice, and nothing available through the Platform is a substitute for professional care; any health-related services are provided solely by independent, appropriately licensed providers.

11. User Content and License

You retain ownership of the content you submit to the Platform (“User Content”). By uploading or posting User Content, you grant PetPad a worldwide, royalty-free, transferable, and sub-licensable license to host, store, use, reproduce, modify, adapt, and display that content as necessary to operate, improve, secure, and promote the Platform. This license does not affect your ownership of your User Content.

You represent and warrant that you hold all rights necessary to submit your User Content and to grant the license above, and that your User Content does not infringe the rights of any third party or violate these Terms or our Community Guidelines.

12. Our Intellectual Property

The Platform, and all materials that form part of it, are owned by PetPad or its licensors and protected by applicable laws. This includes the PetPad name, logo, trademarks, service marks, software, code, design, text, and graphics we provide, but does not include User Content. We grant you a limited, personal, and revocable license to access and use the Platform for its intended purpose, subject to these Terms, and you may not transfer or assign that license. We reserve all rights not expressly granted. You must not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Platform, and you may not use the PetPad name, logo, or trademarks without our prior written consent.

13. Acceptable Use and Community Guidelines

Your use of the Platform is subject to our Community Guidelines, which form part of these Terms and set out the content and conduct that are and are not permitted. Among other things, and without limitation, you must not use the Platform to:

  • Post unlawful, harmful, hateful, harassing, deceptive, or sexually explicit content, or content that endangers or sexualizes minors;
  • Buy, sell, trade, rehome for value, advertise, or otherwise facilitate the transfer of ownership of animals, or offer breeding, stud, or animal-brokering services, except where expressly permitted by PetPad under separate written terms;
  • Depict, promote, or facilitate animal cruelty, abuse, or neglect;
  • Impersonate any person or entity, or post another person’s private information without authorization;
  • Distribute spam, scams, malware, or content that infringes intellectual-property rights.

The full list of prohibited content and conduct, and the way we enforce it, is set out in our Community Guidelines.

14. Gamification, Rankings, and Competitions

The Platform may offer optional features such as points, badges, rankings, challenges, or competitions (“Gamification Features”). Where offered, participation is voluntary and may require opt-in. Rankings or outcomes may be determined using automated or algorithmic criteria and may affect content visibility or discovery.

Gamification Features, including any in-app points or virtual items, have no cash value, are not transferable for money, do not constitute property, and do not guarantee any reward or prize unless expressly stated under separate terms. Any prizes or sponsored benefits, if offered, may be subject to additional rules. PetPad may modify, suspend, or discontinue Gamification Features at any time.

15. Paid Features and Subscriptions

The Platform may offer certain features or services on a paid or subscription basis for regular user accounts, Business Accounts, or both. Where offered, subscription pricing, billing cycles, renewal terms, and cancellation rights will be disclosed at the time of purchase and may be governed by additional terms. Unless otherwise stated, subscriptions do not guarantee specific outcomes, rankings, or visibility, and fees paid are non-refundable except where required by applicable law. PetPad reserves the right to modify or discontinue paid offerings at any time.

16. Advertising and Promotional Content

The Platform may display advertising, sponsored content, or promotional materials, which may be made available to Business Accounts or other users. PetPad does not endorse advertised products, services, or content and is not responsible for the accuracy or legality of advertising materials submitted by third parties. PetPad reserves the right, at its discretion, to review, approve, reject, modify, suspend, or remove any advertising or promotional content, and to impose additional requirements or restrictions on advertising activities.

Where you post content in exchange for payment or other value, or as part of a commercial arrangement, you must clearly disclose it as advertising or sponsored content in accordance with applicable law.

17. Content Moderation and Enforcement

PetPad may, at its discretion and without prior notice, remove content, restrict features, or suspend or terminate accounts to maintain the integrity, safety, or legal compliance of the Platform. PetPad is not obligated to provide a justification for any individual moderation or enforcement decision, except where required by applicable law.

18. Reporting Infringing Content

We respect intellectual property rights and expect users to do the same. If you believe content on the Platform infringes your copyright, trademark, or other rights, please notify us through the “Contact Us” section with a description of the right you say is infringed, the location of the content on the Platform, your contact details, a statement, made in good faith, that the use is not authorized and that your information is accurate, and confirmation that you are the owner of the right or authorized to act on the owner’s behalf. We may remove or restrict any content we consider to be infringing or otherwise in breach of these Terms, and we may suspend or terminate the accounts of users who repeatedly infringe the rights of others.

19. Feedback and Reviews

Feedback may be collected privately following a service. PetPad does not verify, endorse, or guarantee the accuracy of any feedback submitted by users. PetPad may introduce public review features in the future and reserves full discretion, without obligation, to moderate, remove, restrict, or disable reviews or feedback, including where content is misleading, abusive, defamatory, or otherwise in breach of these Terms.

20. Suspension and Termination

PetPad may, with or without notice and at its discretion, immediately suspend or terminate access where there is a risk, misconduct, or legal exposure, and may issue warnings or allow cure periods at its discretion. Termination does not affect any accrued rights, obligations, or liabilities.

Closing your account. You may close your account at any time through the in-app settings. When you do, we handle your personal information as described in our Privacy Policy.

21. Release of Claims

To the maximum extent permitted by law, users and Vendors agree to release PetPad from any claims, demands, or damages arising from or relating to interactions, transactions, or disputes between users and Vendors, including pet-related incidents.

22. Indemnification

Users and Vendors agree to defend, indemnify, and hold harmless PetPad and its officers, directors, employees, and agents from all claims, losses, damages, liabilities, and expenses arising from service delivery, pet injury or loss, violations of law, misrepresentation, breach of these Terms, or disputes between users. Vendor indemnity obligations apply without limitation.

23. No Warranties

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, PetPad makes no warranties of any kind, express or implied, including any warranties of availability, accuracy, merchantability, fitness for a particular purpose, or non-infringement.

24. Limitation of Liability

To the maximum extent permitted by law, PetPad shall not be liable for any indirect, incidental, consequential, special, or punitive damages. PetPad’s total aggregate liability shall not exceed the total fees paid through the Platform in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits PetPad’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects any statutory rights you have as a consumer that cannot lawfully be waived.

25. Force Majeure

PetPad shall not be liable for any delay or failure to perform caused by events beyond its reasonable control, including system outages, network failures, governmental actions, or other force-majeure events.

26. Platform Modifications

PetPad may modify, suspend, or discontinue any part of the Platform at any time. Your continued use of the Platform after such changes constitutes acceptance of those changes.

27. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last Updated” date above and, where the changes are material, provide additional notice through the Platform or by other reasonable means before they take effect. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and may close your account.

28. Dispute Resolution

Before initiating any legal proceedings, the parties must attempt to resolve the dispute amicably through good-faith discussions following written notice. If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts of the State of Kuwait.

29. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kuwait.

30. App Store Terms

If you download the Platform from a third-party app store or distribution platform (an “App Provider,” such as Apple or Google), you acknowledge that:

  • These Terms are between you and PetPad only, not with the App Provider, and the App Provider is not responsible for the Platform or its content.
  • The App Provider has no obligation to provide any maintenance or support services for the Platform.
  • To the maximum extent permitted by law, the App Provider has no warranty obligation for the Platform; if the Platform fails to conform to any applicable warranty, you may notify the App Provider, and where that provider is Apple, Apple may refund the purchase price (if any), with no other warranty obligation.
  • The App Provider is not responsible for addressing any claims relating to the Platform, including product-liability, regulatory, or intellectual-property claims.
  • You represent that you are not located in a country subject to a relevant government embargo and are not on any government list of prohibited or restricted parties.
  • The App Provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as such.

31. General Provisions

  • Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
  • No Waiver: A failure to enforce any right or provision does not constitute a waiver of it.
  • Entire Agreement: These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and PetPad.
  • Assignment: PetPad may assign these Terms without restriction; you may not assign your rights without our prior written consent.
  • Survival: Any provisions of these Terms that by their nature should survive termination will survive, including those relating to User Content licenses, intellectual property, payments and amounts owed, release of claims, indemnification, limitation of liability, disclaimers, governing law, and dispute resolution.
  • Order of Precedence: These Terms, the Privacy Policy, and the Community Guidelines together govern your use of the Platform. Where you use a feature that has its own supplemental terms (such as a paid subscription or a competition), those supplemental terms apply to that feature in addition to these Terms and prevail in the event of a direct conflict for that feature only. In all other cases, these Terms prevail. The Privacy Policy governs how we handle personal information.

32. Language

These Terms may be provided in English and Arabic. In the event of any conflict between the two versions, the Arabic version shall prevail.
